Tobacco and E-cigarette Conviction Report
Region of Waterloo inspects all tobacco and electronic cigarette retailers for compliance with the Smoke-Free Ontario Act. Along with education, retailers may be ticketed. The table below shows a five-year history of sales-related convictions involving either a tobacco and/or vapour retailer. The table displays convictions from October 18, 2018 onward.

Prospective buyers of tobacco retail businesses should carefully consider the conviction history table above and contact the Region of Waterloo to confirm conviction history. Section 22 of the Smoke-Free Ontario Act states that if all the following conditions are satisfied, the business is subject to an automatic prohibition against the sale, storage and delivery of tobacco products:
- An owner of the business that operates or operated in the place has been convicted of a tobacco sales offence committed in the place.
- During the five years preceding the conviction referred to in point 1 above, the same owner of the business that operates or operated in the place, or a different owner of a business that operates or operated in the place, was convicted of a tobacco sales offence committed in the place.
- The period allowed for appealing the conviction referred to in point 1 above has expired without an appeal being filed, or any appeal has been finally disposed of.
Automatic prohibitions are applicable from six to 12 months.
When issuing an automatic prohibition, the Ministry of Health and Long-Term Care will notify the person who owns or occupies the place and all wholesalers and distributors of tobacco in Ontario.
