Requirements and Enforcement

  1. A Licence issued under the Taxi by-law is non-transferable and is personal to the licence holder. 

  1. All individuals licenced under the Taxi By-law must adhere to its requirements. Licences are subject to conditions outlined in Schedule “C”. Insurance and provincial licences must remain valid and not be suspended, canceled or revoked.  

  1. If a licencee’s insurance or provincial licence is suspended, canceled, or revoked, they must return their licence to the Region of Waterloo within 24 hours of the incident.

  2. Licences returned due to non-compliance can be reclaimed. However, reinstatement of the licence requires proof of compliance and valid insurance or provincial licence. Any additional requirements for licence reapplication must also be fulfilled.  

  3. A Taxi-cab Owner/Vehicle Licence can only be used on the specific vehicle for which it was issued.

  4. If any licence is  lost or damaged, the licence holder must apply to the Region of Waterloo for a replacement and pay the required fee.

  5. Everyone licenced under the Taxi By-law must comply with the Highway Traffic Act or any other applicable law. 

Reporting  

Any report or notification to the Region of Waterloo required by the By-law can be submitted during holidays or after business. Submissions can be made via email or by calling the Region’s call centre using the contact details provided by the Region of Waterloo. 

Licence Renewal 

  1. Licence holders must provide all information and documentation requested by the Region of Waterloo for renewal. 

  1. All existing by-law provisions apply to renewals, with any necessary adjustments. 

  1. Fees for renewing a licence are determined by the Region’s Fees and Charges By-law. 

  1. Renewal applications must be fully submitted to the Region of Waterloo before the current licence expires. 

  1. Failure to submit the renewal application before the current licence expires will result in new application fees being applied. 

Discrimination 

No one who holds a licence under the Taxi By-law shall discriminate against any person because of race, ancestry, place of origin, colour, ethnic origin, citizenship, creed, sex, sexual orientation, gender identity, gender expression, age, marital status, family status or disability in relation to the provision of a Taxi-cab service or otherwise contravenes the Human Rights Code. 

No one who holds a licence under this Taxi By-law can charge a higher fare or additional fee to persons with disabilities for the same trip, and/or a fee for the storage of mobility aids or assistive devices. 

Inspections 

Licence holders must allow the Region of Waterloo, a Municipal Law Enforcement Officer or Police Officer, upon demand to inspect any of the following: 

  • Taxi-cab
  • Taxi-cab Meter
  • Service Records (written or electronic records of taxi services)
  • GPS recording

Suspension and Revocation 

  1. The Region can refuse, suspend, or revoke licences if: 

    • The behaviour of the applicant or their company indicates they may not operate legally, honestly, or with integrity. 

    • There is a reason to believe they pose a danger to the health or safety of anyone. 

  1. Before acting upon suspending or revoking a licence, a hearing shall be held upon the Statutory Powers Procedure Act, with some exceptions. 

  1. Where appropriate, the Region may impose special conditions upon the person as a requirement of being issued or holding a licence. The Licensing and Hearing Committee shall exercise this authority; however, it may be exercised by the Region of Waterloo if there is an immediate danger to the health or safety of any person or the public. 

Appeal 

  1. If dissatisfied with the decision from a hearing, a person can request a Council review within 15 days of the decision of the Licensing and Hearing Committee or Region of Waterloo. The request must specify the desired outcome and reasons for the review. 

  1.  The Region of Waterloo shall submit the appeal application and the decision of the Licensing and Hearing Committee or the Region of Waterloo.  

  1. The individual applying for the review should be given notice of the Council meeting where the review will take place and be permitted to attend as a delegation. 

  1. Decisions about revocation, suspension, or special conditions are put on hold until Council finishes its review.  

  1. After the review, Council can: 

  • Uphold the original decision
  • Grant the changes requested by the applicant, fully or partially
  • Provide another resolution they find suitable

Emergency Suspension 

The Region of Waterloo can suspend a licence without a hearing if it poses an immediate danger to the health or safety of any person, or to any property. The Region of Waterloo can suspend the licence without a hearing subject to the following: 

  • Providing the licence holder, in writing, the reasons for the suspension, and opportunity to respond.
  • The suspension shall not exceed 14 days.  

Return of Licence 

When a licence has been suspended, or revoked, the licence holder shall return their licence to the Region of Waterloo within 24 hours of written notice.

Notice can be given directly to the licence holder or sent via mail to the address provided by the licence holder. When sent by registered mail, the notice is considered delivered 5 days after the mailing date. 

Penalty 

If a violation of the by-law is confirmed, the Region of Waterloo or a Municipal Law Enforcement Officer can order the person responsible to stop the activity and the following may apply: 

  1.  A fine of up to $5,000 may be issued 

  1.  Daily fines of $100 to $5,000.  

  1. Courts may issue orders preventing further violations  

Administration and Enforcement 

1. The Region of Waterloo has the authority to:  

  • Prescribe required forms and software for use under the Taxi By-law
  • Issue licences to applicants who meet the specified conditions
  • Refuse or delay licence issuance or renewal until a hearing is held
  • Specify required accessibility training
  • Check and confirm information provided by applicants or licence holders 

2. The Licensing and Hearing Committee oversees the Region of Waterloo and the administration of the Taxi By-law. 

3. The Taxi By-law may be enforced by the Region of Waterloo, a Municipal Enforcement Officer or a Police Officer.
